An Overview of Guardianship

Guardianship is one of those things that rarely do we talk about we really should. There is a good chance you may never become a guardian but life can change in an instant and having knowledge of the subject can be helpful to you. Children may need a guardian for several different reasons; their parent may die, the may be neglected, or they inherit a great deal of money.

If you are named a guardian of a child in someone’s will the shock may be a bit overwhelming. This means that you are now responsible for providing food, water, shelter, clothing and most importantly love to the child. You are required to educate the child and take care of their medical and dental expenses. You are now required to keep them safe and protect them as any parent should.

There is a chance you may need to apply for guardianship of an adult. This can happen with the adult is not capable of making sound decisions because of a circumstance like illness or addiction. It is a huge decision and one not to be taken lightly. The individual may resent you for your actions even if they are in their best interest and the legal process can become quite lengthy. If you win you would be responsible for where they live, their medical treatment, how they spend their money and who they can marry.

There are less invasive alternatives to guardianship where you would be given a limited scope of decision making power. For example, you may only make health or financial decisions.

It is a difficult process and hiring a professional to help you sort through the mess is imperative.
