Pasadena-Based Materia, Inc. and Evonik Industries Reach Agreement on Catalyst License

Pasadena-based Materia, Inc., a world leading supplier of high performance catalysts and advanced polymers, has entered into a license agreement with Evonik Industries, a German chemicals supplier, related to catalysts used in olefin metathesis, a reaction in which two compounds exchange ions, typically with precipitation of an insoluble product.

The agreement follows a patent infringement case between the two companies, which a jury trial in the Federal District Court in Wilmington, Delaware decided in February.

According to the terms of the agreement, Evonik allows Materia to make and sell the catalysts that are covered by an injunction issued by the court in August.

The agreement also permits Materia’s customers to use these catalysts in their products.

“We are pleased to enter into this mutually beneficial agreement with Evonik to ensure that Materia’s entire Grubbs catalyst portfolio continues to be available to our customers globally,” Nitin Apte, Materia CEO, said in a company statement. “This is an important step in the settlement process and we are encouraged to be moving forward.”

The license agreement addresses Evonik’s United States Patent Numbers 7,378,528, 7,652,145 and 8,153,810 and related U.S. and foreign patents and patent applications. The court had reportedly decided that 50 of Materia’s catalysts infringe Evonik’s ‘528 patent. The Court also held previously that Evonik’s catMETium RF metathesis catalyst products do not infringe Materia’s US patent 7,622,590.

Materia Inc., whose headquarters are at 2674 East Walnut Street in Pasadena, develops and manufactures catalysts and advanced polymers that solve complex problems for chemical, electronic, energy, industrial, pharmaceutical and transportation companies.
