Two of the three teenagers who police said tried to attack and rob an off-duty U.S. Customs and Border Protection officer in Arcadia last Friday have been charged, according to an update from the Los Angeles County Sheriff’s Department said Thursday.

In the incident, a third suspect, Pasadena resident Darrius Smith, 15, was shot and later died in a hospital.

The Los Angeles Sheriff’s Department said prosecutors reviewed the evidence in the case and filed attempt robbery and assault charges against the other teens, Smith’s 14-year-old cousin and another 15-year-old on Wednesday, May 31. The sheriff’s department said the 15-year-old subject will be arraigned on June 6. Smith’s cousin remains in a hospital for gunshot wounds sustained during the incident.

Although charges have been filed, LASD Homicide Detectives are continuing their investigation into the circumstances surrounding the officer-involved shooting, an update from the Sheriff’s Information Bureau said.

The incident took place at about 8:15 p.m. on May 26 in the area of First Street and Colorado Avenue in Pasadena.

The sheriff’s department maintains that the off-duty Customs and Border Protection (CBP) officer involved acted in response to what they said was a robbery attempt and an assault on the officer, and shot at the subjects when he felt threatened. It said officers found “a replica semi-automatic handgun which looks exactly like a real handgun” near where Smith fell on Colorado Blvd., about a block away from the scene of the shooting.

“The manufacturer of the gun boasts on its website that they are the masters of look-alike air guns and that their replica guns are realistic looking,” part of the LASD update said.

LASD also described what surveillance video from the Gold Line Metro Rail showed about the incident.

“The victim exited the train at the Arcadia Station and walked north on First Avenue from the train station, followed by the subjects. Video shows the subjects running up on the victim where the robbery and shooting occurred. After the shooting, 15-year-old Subject Smith is seen running away with another 15-year-old subject, north on First Avenue and then east on Colorado Boulevard. Subject Smith is found a half a block away from the scene of the shooting by officers from the Arcadia Police Department,” the LASD update said.

LASD said Smith sustained two gunshot wounds to his upper body and two gunshot wounds to his buttocks. The Los Angeles County Department of Medical Examiner-Coroner conducted an autopsy on Wednesday.

Deputies also said the 14-year-old, who sustained two gunshot wounds, was treated by paramedics and transported to a local hospital. The other 15-year-old, who was not injured, was later found at a residence nearby and taken into custody.
