Woman Sues After Several Starbucks Locations Allegedly Overcharge for Breakfast Sandwiches

A California woman says that Starbucks locations in several cities in the Los Angeles area charged her more than the posted price for specific sandwiches on their menu, and has filed a proposed class-action lawsuit against the coffee chain.

On May 19, Sarah Martin filed the paperwork for a proposed class action lawsuit in Los Angeles Superior Court, accusing Starbucks of misrepresentation, fraud and false advertising. The lawsuit came after Martin visited Starbucks locations in Sherman Oaks, Los Angeles, Pasadena, South Pasadena, Granada Hills and Encino during April and early May.

In multiple stores, she noted that the advertised price for a Reduced Fat Turkey Bacon Breakfast Sandwich was $3.45; the Sausage and Cheddar Breakfast Sandwich was advertised at $3.25. Her lawsuit reports that Martin was charged $3.75 for the turkey bacon breakfast sandwich and $3.45 for the sausage breakfast sandwich at each of the locations she visited, despite the advertised price being lower.

According to City News Service, Martin’s lawyer did further research and discovered other incidents of customers being charged more than the advertised price for these breakfast sandwiches. Her lawyer, George Azadian notified Starbucks in writing on May 19, that under the California Consumers Legal Remedies Act, his client would seek actual and punitive damages if the violations are not rectified by June 19.

The coffee chain is looking into Martin’s claims, according to a report from City News Service.
