U.S. Supreme Court Asks for Biden Administration Opinion on Billion Dollar Caltech Patent Dispute With Apple, Broadcom

The U.S. Supreme Court on Tuesday asked the Biden administration’s opinion on a bid by Apple Inc. and Broadcom Inc. to revive their challenges to patents owned by Caltech in a case in which a jury originally awarded Caltech $1.1 billion in damages.

The case was sent back for a new trial after the U.S. Court of Appeals ruled the amount of the award was not supported by the facts of the case and vacated the jury verdict.

The jury decision had ordered Apple to pay $837.8 million and Broadcom to pay $270.2 million to Caltech,  

The new trial is scheduled to begin in June.

Reuters reported the Supreme Court justices asked the U.S. Solicitor General to comment on a lower court’s decision that prevented Apple and Broadcom from arguing the patents were invalid at trial.  

Apple and Broadcom say they should have been allowed to challenge the patents’ validity at trial but the appeals court upheld the trial judge’s decision to block the companies from making the arguments, Reuters reported. 

Last September, Apple and Broadcom decided to appeal that decision to the U.S. Supreme Court, telling the justices that the Federal Circuit misread the law, which they said only bars arguments that could have been raised during the review itself, not in the petition, according to Reuters.

Apple, as a Broadcom customer, reached a $15 billion chips supply agreement with the company in January 2020. According to other reports, Apple is planning to replace Broadcom’s chips with an in-house design in 2025.

The Reuters report said Caltech has separate cases against Microsoft Corp, Samsung Electronics Co, Dell Technologies Inc and HP Inc., accusing those companies of infringing the same patents. The cases are pending. 

Reuters said that Caltech had no comment on the Supreme Court’s order.
