The Los Angeles District Attorney’s Office has declined file formal involuntary manslaughter charges against Oscar Carrillo, who confessed to lying in a 911 call which led to the fatal Pasadena police shooting of Kendrec McDade on March 24.

“We have rejected it pending further investigation and we are doing legal research,” District Attorney’s Office spokeswoman Sandi Gibbons said told the Los Angeles Wave Wire Services.

Pasadena Police  arrested Carrillo last Wednesday after he allegedly confessed to fabricating portions of a 911 call which led to police pursuing and fatally shooting Kendrec McDade, 19, of Azusa, whom they believed was an armed robber.

In fact, McDade was not armed.

Police say that Carillo subsequently confessed to lying in his 911 call in order to provoke a faster police response.

On Saturday, Pasadena police dept. spokesperson Lt. Phlunté Riddle confirmed to Pasadena Now that Carrillo is in the United States illegally.

Riddle confirmed reports that Carrillo has been living in the United States and working at a Pasadena store and that he is without proper documentation. The police department has no jurisdiction over immigration issues.

Carrillo faces immigration proceedings and possible deportation.

Carrillo, 26, of Pasadena, claimed he had been accosted by the two and that the pair had stolen a laptop computer from his car.He said he was giving chase in his car as he dialed in the 911 call.

Police now believe that Carrillo was lying and that neither youth was armed.

Officers responded to  the call of an armed robbery and saw one suspect running near Fair Oaks Avenue and Orange Grove Blvd.

The officers pursued the suspect north on Sunset Avenue from Orange Grove Blvd and as they neared him, police say the officers “observed his hands at his waistband. Fearing for their lives they fired multiple shots striking the suspect.”

The suspect was transported to local area hospital where he died.
